Hi...

I am working in private IT company nearly two years going to complete. In that company they are putting bond for employees who are joining as freshers and also they collected 10th and 12 mark sheets . If we break the bond then we have to pay 3 lakhs with these certain constraints only I also joined in that company. Now suddenly, my situation was not good. I need to go back to my home. Now I asked my original 10th and 12th certificates to them they are saying pay the amount and collect your certificates and experience letter. Otherwise we will take official action & We will not provide any certificates for you..Is there any possibility whether the company take action to me? Can I get my mark sheets back?

A.Issue legal notice demanding your original certificates and compensation for mental agony and damages.
As for the bond taken by them from you, it will be dealt with in Court of Law. Looking to the terms/conditions therein.
Give your reasons. Court will decide. Take legal assistance of a local lawyer.

A.What are the conditions mentioned in your bond. Is there any clause regarding your marksheet? What exactly the clause of 3lac say? Pls answer for further advice

A.They cant retain you original certificates however they could ask you to pay bond amount. But that bond amount must be reasonable. This depends on case to case as what amount is reasonable or not.
The bond amount could also be waived if you could show a reasonable and believable facts and circumstances.
To this you must issue them a legal notice through an advocate asking them to return your certificates and experience letter.

A.You have not stated the Bond terms & conditions, whether signed in stamp Paper duly witnessed and signed as per company requirement. You have to pay the amount for non compliance of bond clauses & terms & conditions.Demanding & retaining to execute the bond terms & conditions is also against the law.better to contact a Employment & Labour and service matter expert lawyer to help & protect you on all aspects of the serious issue quickly.

A.On the other hand, you can take action against the company. First please send them a legal notice seeking your original marks certificates. If they do not respond, you can file a suit for recovery of your certificate and also compensation.

A.First you need to inform them in writing stating the grounds for leaving the company. I they are not responding issue a legal notice to the company and its directors to relieve you and handover the original certificate.
