Me and my wife separated for more than 2.5 years. I have a baby girl, who is staying with her mother. My wife is state govt. employee in West Bengal, and I am private company employee. Can it be an added advantage on behalf of me since we are separated for more than 2 years and having no communication at all? Can my wife demand Alimony, provided she is working?

A.she can ask for alimony and get it i she proves something against you in divorce case.
she can claim maintenance for baby girl but not for her until there is huge salary difference.
Better you file divorce case based on desertion.

A.wife can claim for maintenance of daughter only .If you take daughter with you then there is no question of giving her maintenance.

Your wife is state govt. employed so she cannot ask for maintenance, but she can ask maintenance for the daughter.

A.sir you should know the approach of the court and a little about the provision of maintenance to wife and children.
your wife can very well ask for maintenance from you if she is not able to maintain herself now at par if she would have been in conjugal relationship with you. but in your defence, you have a very strong point that she is independent and is capable of maintaining herself and is an employee under the state gov.
secondly, yes she could claim alimony also.
thirdly, since your doughter is residing with her than she can ask for maintenance fromyou for your daughter.

A.जहाँ तक आपकी पत्नि का भरण पोषण मांग ने की बात है।यदि वह सरकारी नौकरी मे है।तब ऐसी पारिस्थिति मे वह आप से भरण पोषण नही मांग सकती।बल्कि अपनी बेटी के लिये भरण पोषण मांग सकती हैं।
