My dads brother have put there name on electricity bill meanwhile the commercial area was of my grandmother and he did this when she was alive without legally knowing her about all this and then she passed away after that commercial area went into construction now the question do we need to do something about this now or wait till commercial area is ready to sell? will we be able to get our part in this area as dadi never said it was whole for dads brother!

A.By paying electricity bills or have having name in bill or payment of house tax does not constitute any ownership right in respect of such property. Your father is entitled to claim his share and can file suit for partition of the property.

You can go ahead and claim for partition since the property in question still remains undivided, as per your narrated facts. Again, if your dad's brother does not agree to partition, you can always file a suit for partition before the family court. Further, the name of your uncle on the electricity bill does not prove his sole ownership over the commercial area.

The name of your uncle on the electricity bill isn't a conclusive proof of sole ownership of the commercial area. If partition has not been done yet of the property in question, then you still have a chance to claim for your share.

A.Since there is no WILL, You will get your share.
Your Dad brother is legal heir and will get his share from property and not complete property.
so if you will spend in construction, he will get benefit of your money.
sort it before spending more on construction.
