Hi,

I am purchasing a piece of agri land in karnataka, middle man says agreement willl be signed by him, he already has an agreement with land owner, in agreement with me he shall cite the same and have the agreement done.
should i proceed?

A.Middleman's signature on sale deed in your favour is of no use to you unless he produces POA in his favour or his registered Agreement which should be mentioned in your agreement in order to reflect chain of transfer of the property. Check his documents first before taking further steps to buy.

A.No. He cant execute agreement in favour of you on the basis of agreement alone. He must have a PoA in favour of him than he can transfer the said land to you

A.You cannot register such an agreement. Please ask him whether he has any power of attorney in his favour. If has, he can enter into an agreement on behalf of his principal. But an agreement holder entering into agreement with you may not be enforceable.

A.Hi,

I think the middle men already executed an agreement with the owners. On that basis they are negotiating the deal with you. So please ask them to share the agreement copy with you and in your agreement also you need to refer the agreement executed between the owner and the middlemen. It is normal practice nothing to worry.

A.Whether you should proceed or not can be decided on the basis of agreement of landlord and your so called middleman. If necessary legal technicalities are incorporated in agreement, then go ahead, otherwise arrange for agreement drafted on your own terms which facilitates reasonable advantages to either side of the sale process of purchasing land.
