My wife live in relationship with her boyfriend and they have a daughter . My wife force me to take the baby for mine . She force me to give money for her and the baby. And She Mar-rage with other boyfriend even she did not gave me divorced .
Will I file a criminal case against my wife for bigamy ?
or any other case
and what can i do with the baby ?

A.What you were doing till now and why ?
go for DNA test.
also file police complaint or private complaint for bigamy.
You dont have to pay any maintenance to anyone.

A.You can case for divorce on the ground of cruelty. Adultery and bigamy are toughest point to prove. Merely living in relation with boy friend does not prove commission of bigamy or adultery. If you have proof of marriage then can file case and complaint of adultery and bigamy. Second marriage is illegal and void and child from such illegal marriage is also illegal but such illegal child do have right of maintenance etc. You can get the DNA test of daughter to establish the paternity of daughter.

You can complain against the wife for bigamy. You can divorce the wife for bigamy as well. You can disown the baby, you do not have to provide maintenance for the baby.

A.Hi,
you can File a divorce, As There are 2 ways to get a Divorce:-
A Contested Divorce - In this, you have to prove the ground of divorce as mentioned under the act. Generally, its time taking process. and the opposite party has to defend the case. In this One party is ready to take the divorce but the other is not. It can be file after 1 year and the grounds are as follows.
1. Adultery
2. Cruelty
3.Desertion
4. Conversion
5.Insanity
6.Venerable Disease
7.Renunciation
8.Presumption of death. ETC
B. Mutual Consent Divorce: Under sec 13 (b) of HMA, 1995.:- In this, Both parties are ready to take the divorce by amicably agreed to dissolve their marriage with mutual consent. Parties ca file this divorce after completion of 1 year of marriage but in such matters, the court gives 6 months of the cooling period that is waived period.
In this way of divorce Process is not lengthy. Hence it is smoother than Divorce by other means and it contains 2 motions of the period of 6 Months

You can file a private complaint against the wife for bigamy. You can disown the baby and you won't have to provide for the maintenance of the baby. You can also seek divorce from the wife.

A.Don`t give police complaint, file a private case in Magistrate Court( PCR). disown the baby. Ask vidhikarya to reach me.
