A.You have to take divorce from your wife and then think about second marriage. Our law not given permission for second marriage without divorce from the first spouse.

A.Hi,
If you do not divorce your first wife then you cannot enter into a second marriage because bigamy is illegal in India. And only impotency is a ground of divorce and not infertility. If your wife is impotent then you may proceed to file a suit for divorce as per S.13 of the HMA.
If you found my answer helpful then kindly rate me.

A.Hi,
You can only enter into a second marriage after you've separated from your wife through a divorce. Only impotence is a ground for divorce and not infertility. If your wife is impotent then you may file a suit for divorce before a family court u/S 13 of the HMA.

A.first you have to obtain divorce then you may remarry. if the marriage is not consummated yet because of the impotency of the first wife then it could be a ground for declaring the marriage as void. But if the marriage has been consummated but due to infertility the first wife is not getting pregnant then it would not give you a ground to divorce.
