I want divorce from my wife. Earlier we were agreed in mutual divorce but now what happened to her she denied for it. How can i get divorce now ?

A.u can file a divorce under section 13 in the matrimonial court and after that u will get the divorce

A.Best course is to go for divorce by mutual consent, notwithstanding the differences between the parties.
Else, file a petition for divorce stating grounds. In the latter case it will take its own time to reach finality.

A.Its better to agree her for mutual consent divorce.
If she is not ready for that than file a divorce petition u/s 13 of HMA stating all facts and circumstances which proves that you are entitled for divorce.

A.You should understand that it involves lot of preconditions and requirements under the law.In a contested divorce not only both parties even the Lawyers also have to convince the court on various grounds.better to consult a Family matter lawyer to guide & help you on all aspects of the issue for quick settlement of the issue.

A.If this is not a MCD then you can file divorce petition for the divorce due to cruelty and not compatibility issues in the family court.

A.It is always better to go for mutual as contested one is troublesome and time taking.
Also discuss with a lawyer the grounds for contested divorce and then only go for it.

A.You would have to file a petition for divorce. If you are a Hindu, the grounds available to you are cruelty, desertion, etc. You have to state all that happened during marriage and what are the sufferings you went through, why it is not possible to continue your marriage with her. Please file an elaborate petition by paying the requisite court fee and by producing all the necessary documents and proceed with the case like any other civil case. You would have to conduct a proper trial and convince the Court that you have suffered so badly that you cannot be compelled to live with her again.
