Custody of illegitimate child after mothers death

I’m mother of 1 year old baby without wedlock.In case of mother’s death who is eligible for custody of baby?Is father can take custody of baby?

A.yes, father can take custody.

A.Its a very tricky question and unless the father comes forward and claims his right the court might have to intervene and pass a direction to the child's custody rights since you are not married

A.Child is illegal but parents are not illegal. Father is natural guardian of child above five years.

A.Hi,
The biological father of the illegitimate child can claim guardianship only on the demise of the mother. The mother has the first right to custody of the illegitimate child.

The father's claim to guardianship comes only after the mother. Therefore, in the event that the mother dies, then the biological father of the illegitimate child can claim guardianship.
