Defective oximeter provided by seller. Also ordered two got one.

I needed two oximeters but as the prices have gone up and delivery was taking too long on the e-commerce sites I chose to order from a contact which I got from a friend. I started talking to that person namely about my requirements. He quoted me the price to be 890 per pc plus delivery charge90. There was no mention if the product was warranted or not, or if I should keep an unboxing video of the product or not. So then I sent the quoted money Rs.1890(2 pcs of oximeter plus delivery charge 90) through phonpay. Then got the tracking ID which was being shipped by bluedart. I received the product 2 days later of getting the tracking ID on 20th May. As I always do I started taking a video before opening. Opening the package I found only one oximeter without batteries. So I had to stop the recording and go buy two batteries which took me around 45 mins as the shops were closed due to lock-down . Putting the batteries in I found the oximeter was not working.Now when I contacted Ayush he said he wasn't sure why only one product was sent by the vendor where as before he insisted that every product is tested and then sent then how did i receive one oximeter and not the another one. There were no two brands ordered, so hopefully the vendor is not dumb enough to send two oximeters separately, but he kept insisting that the vendor might have sent two oximeters separately, I was also told the products will come from ludhiana, I don't know how it got shipped from patalganga, Maharashtra and then for the defective product he said I should have shown the product not working in the first video only. Now my concern is why wasn't I told that the product was not warranted and why wasn't I asked to keep an unboxing video of the product in one go. I did the video just to be safe by myself. If i didn't have taken that video probably he would have scammed me there too. He doesn't even care that a product he sold isn't working. I ordered the oximeters for me and my friend. Now its for my personal use, I have a brother who has asthma and a father who has diabetes. Now in this pandemic time when I am in need of some kind of assistance this guy is making dumb excuses. I asked him many times nicely but now he has stopped replying.What should I do?

You can file a complaint in consumer court and also can lodge a complaint in NCH as FIR or a police complaint in case of fraudulent transactions through online websites. To register a complaint with NCH you can call on 1800-11-4000 or 14404, you can also send SMS on 8130009809.

If the person is selling his products online also then you can file a complaint. According to National Consumer Helpline, in case of fraudulent transactions a consumer should lodge a First Information Report (FIR) or make a police complaint or to Cyber Cell, if company is not traceable. To register a complaint with NCH you can call on 1800-11-4000 or 14404, you can also send SMS on 8130009809.
