My Mother{under influence of my younger brother] Threatening to File Case Under various OLD AGE PARENTS HARASSMENT clause in UttraKhand against me if I try to sell my share of parental property [Property already in my name with possession ].
How to get SafeGuard against this threat by Mother ?

A.It is civil case.
she can file and you have to pay maintenance to her.
but your younger brother also have to give maintenance to her.
it depends on pension also.

You can resolve this family issue by talking to your family members. You can also enlist the help of counsellors to mediate the dispute between you and your family members and resolve the conflict. A legal battle would be long and expensive. You can deal with the property, if the property is in your name and has been partitioned already.

A.Hi,
Try to resolve the issue amicably, as a legal battle would be a complicated and expensive one. You can try various alternate dispute resolution mechanisms such as mediation and counselling to resolve the conflict. If the share is already in your name and the property is already partitioned, then you are free to deal with it in any manner.

A.This is a family issue and you must try to speak to your mother and settle it down by taking your mother and other elders of the family in confidence. Making this legal issue will makes things dirtier for everyone. Incase things go out of hand then approach the police and submit a GD informing about the situation to safeguard yourself.
