Since this pandemic situation case is getting delayed, we have added section 9 case and we dint received proper response and hence we added to court as a next procedure but due to this lockdown its delayed and its been over 1year, can we add 125 crpc section now immediately under this.

You can consider filing an application for interim maintenance u/S 125 CrPC since there is an unusual delay as per your narration in light of S.9.

A.Hi,
If S.9 is subject to inordinate delay, then you may consider filing an interim application u/S 125 of CrPC and apply for interim maintenance.

A.if sec 9 is taking time then you can file 125 CrPC or DV case for interim maintenance.

A.Hello,
You can file separate petition under the provision of Section 125 of CrpC for order of maintenance of wife and Children. In this pandemic situation you can file the above said application along with interim application for interim maintenance.

A.Sec 125 is for maintenance and it can be added or invoked at any point of time so no need to wait for it. As soon as the court reopens invoke Sec 125 and move the application so that you start getting maintenance to sustain yourself.
