As my boyfrd utilized me physically in d pretext of marriage and I caught him chatting with some other girl regarding dere marriage and finally cheated me and broke up with me ,,,, I hav informed him Dat I will proceed legally if he don't marry me,,,, he hav two elder brothers and dey r not yet married ..... previously my bf used to tell me Dat after two yrs he will marry me though his bros r getting married or not married.... Now as I insisted him to marry after dis issue. He s saying that he will marry me only if his bros r getting married, no matter how many years happen he can't marry me before that... Also after marriage he want me to stay seperately as he don't want me to live with him together. Just for name sake he gonna marry me... Also he don't want me to disturb him by texting or call him till his bros get married....he was so arrogant in d call. I feel like he hav agreed for marriage just to shut my mouth for time being... I dono how many years it will take for his bros to get married....he s not even ready for registered marriage. He told thru call and I hav recorded the call... I felt like proceeding legally and complain against him for cheating me. Shud I wait for his bros to marry by trusting his words or can I proceed legally

A.See the law in this kind of matter is varying and has different court has different opinion on this. It depends solely on how the relationship is build and how both of you are involved and how is he cheating you and based on that only you can either lodge a complaint against him.
But before going legal way you try to settle things amicable by talking to him if possible.

A.Even if you proceed legally against him there are not many chances that he would marry you if he doesn't want to and even the final order of the Court would take long time to arrive. Hence, I would suggest you to not take any decision in haste and think carefully if you want to proceed legally or you want to wait.

A.As i have gone through your complaint , found that u have been cheated in the name of love and false pretext of marriage. so many legal options are available to u to opt for. U can file criminal as a well as civil case against your boyfriend.

A.Hey,
As per section 375 of IPC if a man have sexual encounter with a woman under pretext of marriage and don't fulfil such promise then it is consider rape and punishment is as severe as rape under law. You can file FIR against him if he doesn't fulfil that promise.

A.Hello,

Your facts are self contradicted, Once you said that your boyfriend has cheated you and you broke the relationship and at the same time you are asking that "Should i wait for his brothers marriage by trusting his words or can i proceed legally".

First, you have to chose one stand that you have to marry him or you doesn't want to marry him on the pretext of cheating. If you want to marry him then try to resolve the issue amicably. In this regard you can take the help of yours and his family members or family friends or mutual friends.

and if you think that you are cheated and feels deceived then you can take legal action by filing complaint against him.

If you don't trust his words then you file FIR against him under section 375 of IPC for having sexual relation under false pretext of marriage then it is punishable as rape under law.

A.If your words are true, I am sure enough that he is not going to marry you. It's because if he would have been willing to marry you then he would not have stated that you should not call him or text him until his brothers are getting married. Moreover you can't live a happy married life with such a person who doesn't care about you and thinks of living seperately after marrying you. He is just avoiding you. You can take legal step against him but you need to prove that he has cheated you by having illicit relationship with others. But personally I would suggest that in future if he gives you the proposal of marriage, don't marry such a person else you will have to regret.

A.While there is no specific legal provision under IPC expressly classifying sexual intercourse on false promise of marriage as rape, however, on the basis of judicial precedents, you can contend that your consent was obtained fraudulently and accuse him of rape.

If you were living together you can claim benefits of a live- in partner.

A.As such no case of cheating or rape is made out in given facts. As per law if two major persons by mutual consent have sexual relation or enjoyed sex in that case no case of cheating or rape is made out.
