A.Hi,
Assuming that you are asking how to get a restraining order. To get one done in your favour, you would have to file a petition at the appropriate court (civil/criminal) and also give a written statement stating why you require it. In case of domestic violence, you can simply get it done by approaching a police officer or the magistrate.

A.Yes you can do so but then you have to tell to the court why do you want an injunction order to be passed. You can speak to a lawyer and discuss your matter to have full understanding of your case then take a call on how to proceed.

A.The concept of "restraining order" per say does not really exist in the Indian legal system. It is mainly an American law concept.
Instead we have the concept of injunction in Indian law. Therefore, depending on the cause for which such restraining order is required, you can file an application for injunction before the appropriate court.

A.You haven't stated your matter, however you can approach to a respective Court and file petition for which you will require to issue notice to the opponent through a lawyer if this is a fresh matter and then you may file a petition in the local Court of your jurisdiction through your lawyer.

In India there is no scope of restraining order but it could be issued in the form of injunction under Civil laws. An injunction could be temporary or permanent. An injunction stops a person or an organisation from continuing any activity. For the criminal matter you should file complainant to magistrate or FIR with police after case is heard then judge can pass a restraining order.
