Noisy Neighbours, Poorly Constructed House
2 years ago
There is a new house constructed on the adjacent of my house. They have covered all of their back area, and have constructed the kitchen against our bedroom wall. Now, the issue is, that there are tenants who make significant noise of using mortal and pestle, banging utensils, and there is even sound of generally usage of kitchen. After multiple requests to not make noise after 10 PM to the tenants as well as landlord, there is no relief. We even requested the landlord to move the stove away from the common wall, so there is less noise, but they do not agree.
Is there something we can do? The noise is very loud, of banging nature, and we're senior citizens not able to sleep, and not even able to do our day time tasks properly because of this nuisance.

This might constitute a case of nuisance at a private level and can be dealt with by lodging a police complaint u/S 268 IPC. However, neighborly matters need not escalate much and the initial step would be to solve the differences by peacefully talking to them.

The very first step would be to try to solve the dispute amicably with your neighbors a by telling them about your problems. If they do not pay any heed then you can file a police complaint about private nuisance u/S 268 IPC.

In worst of the situation you may lodge criminal complaint under Section 268 and 290 of IPC.

You already tried requests but they will not change themselves for you.
If they not built house as per norms then complain to municipal area for demolition.
Then they will not move only stove but even kitchen.
