Mutual divorce procedure with nri husband

I am married last year in December with an Australian citizen who is a person of indian origin but due to his mother & his torture i don't want to continue this marriage anymore, please let me know the procedure for the mutual separation & it's registered in india & also solemnised in india.

A.Further to my response, since the marriage took place last December, you need to complete one year for filing petition. Anyway contact local lawyer.

A.Need to file petition for divorce (by mutual consent) at the place where you both last resided together. Or, at the place (in the jurisdictional District Court) where marriage was solemnized. If you profess Hindu Jain Sikh Buddhist faith, then provisions of Hindu Marriage Act will apply. If not by consent, then on grounds of cruelty. Contact Advocate locally.

A.In your local jurisdiction seek a lawyer's help to file the case for mutual consent divorce and then get it done. But beware that you cannot file a case until the expiry of one year from the date of marriage.
