Service Rule Service Rule

I am a govt employee, I had a conversation with my senior Official - I have recorded automatically call(datas were not important) and I shared to my friend. He has posted it into whatsapp group. Finally the Senior official complained in the Department-Govt.

1. Will i get disciplinary action
2. As per Indians rule- is recording a call a crime?

A.Hi,
As per your narration, disciplinary actions might be inevitable at this point since your department's private and confidential call has been exposed. This leads up to misconduct on the part of employees. However, it can't be categorized as a crime.

A.Hi,
Recording calls is not a crime per se. However in your case, the recorded call has been published which leads to a misconduct on your part. You are liable for disciplinary actions. However you will still have constitutional and administrative remedies available in your favour.

A.1. You may have to face disciplinary action for this as you are not supposed to share your official confidential matters with your friends and relatives and you have certainly violated the norm.

2. There is something called privacy protection and under that you are not supposed to record all calls and even if you record you are not supposed to make it public. You need to respect the privacy and confidentiality of the people and in case yo wanted to bring out something which you think was like conspiracy then you should have given that evidence to your superiors or to police but no to the general public.
