Bike dealer against wrong policy Bike dealer against wrong policy

I had purchased bike from company showroom through cash payment which includes bike+RC transfer +insurance +accessories.
Issue: With insurance policy
Dealer give me (1+4) year insurance policy i.e first year complete + 4 year third party. Now i goes to company for rebnewal of first year insurance policy, but insurance company email me that dealer didn't give me genuine policy.

So, I had stoped using bike and requesting dealer, for clearity. He is ready to renwe insurance.
I want to file a case, agains unfair trade practice and 420 for cheating and will impose high panalties.
Dealers wants to negiotate..., so pls suggest how to handle...

A.Yadi aap ke pass sufficient proof hai. Tab aap company ke virudh forgery ka case file kar sakte hai.
Or aap consumer forum me bhi compensation ke liye case file kar sakte hai.

A.Hi,
The dealers, the insurance agency, and the consumer are in a tripartite agreement and there has been a clear breach of contract. You can sue them for providing insurance on a false basis and file a cheating case u/S 415 of the IPC. You may also consider filing a complaint before the State Consumer Redressal Commission.

A.See its your choice whether you want to negotiate or you wan to file a case for unfair trade practice.
BY negotiating you may get your thing done and by filing a case you shall be able to teach him a lesson not to cheat with customers.

A.Okay so lets do this way. First if you have proof of the fact that the insurance policy was given to you by the company then you are all set to get not only compensation but also penal action against the company. In case you do not have proof of the same then you will have to either collect some or manufacture some with you intelligence. You can meet a good lawyer who will guide you on how to collect the proofs, I am not inclined to reveal those in public.
