Hello, long back i was caught by police for open drinking (I don't know which section applies for that), next day i went to court and paid fine of 300rs infront of magistrate. Upto to know it's fine but problem is that while applying for Govt. Jobs and bank jobs in the application there will be a question like 'Whether procesuted, fined, convicted, sentenced in any court of law?' and also like 'Whether there is any adverse report, antecedent, moral turpitude against your name?' This is my issue what should mark in the application, i mean Yes or no. If yes what will be the consequences? or if no what will be the consequences?. Thorough explaination is much appreciated, thank you.

A.These petty crimes are not coming under the category which are to be mentioned in your job application as "yes I was convicted". These are not conviction kind of cases but are called petty cases wherein you pay fine for breaking rules. In case almost everyone of us here and there would have paid fines for breaking one or two rules like traffic light jumping, parking in no parking zone, driving in one way etc. for these you will not be asked to mention in the job application.

A.Hey,
If you don't mention your criminal record in the application form asked by the employer then if you get the job and later it is found by employer that you hid this information then it might be breach of contract and you might lose your job.

A.Hi,
It is advised to be honest on your application for the job and although there is no law related to criminal background check in India. But if you are caught by your employer for lying about your criminal record then it might lead to breach of employee- employer contract between you and your employer and you being liable and lose the job. You might explain it later in the interview round.
