How to claim the insurance amount when the wrong nominee name is given
2 years ago
My wife delivered a baby boy and after 7 days she was expired . She was working in software firm where the employees had a term insurance benefit from company. She didn't changed the nominees post marriage. So the claim was received by her parents and they were not willing to give that amount to my new born son( asking them to do fd on my son name ).Can the nominees use the money ? Is there any way that I can file a case to get that claim amount to my new born son?.

Aap or aap ka beta aap ki wife dawara chodi gai dhan rashi ke absolute sawami hai. Isliye aap dhan rashi ko recover karne ke liye civil court me case file kar sakte hai. Jisme aap ko kamyabi milegi.
You can serve a legal notice to the wrong nominee wrt the wrong insurance claim. You also have the additional option of choosing to go the insurance ombudsmen in your region and post your query to them.

Yes, the nominees will be not liable if they were using the insurance claim since procedurally, the wrong name has been given. You may file a suit for compensation concerned with the insurance before the civil judge's court.

A.See since the nominee name was not changed so as per the policy and their rules the insurance company has rightfully given the money to the nominee.
Now what you can do is that you will have to file a civil case ( Money suit ) in the civil court to recover that money as you and your son are rightful legal heir to receive that amount. Immediately get in touch with good civil lawyer and sent your in-laws a legal notice followed by a civil suit.
