Subject: Regarding the validity of a employment bond.
Matter: Hi, on 21apr 2021 i joined a company which had a bond to be signed but it did not incuded any stamp paper or notary so is it a valid bond or not.

Sir, this bond also enforces me to submit a post dated cheque to submit with them but i haven't submitted it yet.

One more thing is, they do not have hard copy of that bond it was just signed and scanned by phone and sent to them in pdf format.
Now i want to quit because they are nit giving the work that i want to do they just lied about the technology.

Please help me out of it asap, i feeling so much mentally disturbed.

A.Dear Sir, Never share signed blank cheque as it may be used easily against you at any point of time and file a criminal case under section 138 of Negotiable Instruments Act. As regards bond seems to be invalid since scanned signature is not valid etc.,

A.These kinds of bonds are accepted traditionally and are in practice and many companies are taking it but legally speaking they are not valid and courts do not appreciate this. Bonds are one sided agreement and there have been judgement where courts have struck down the validity of these employment bonds but the issue is neither the company nor the employee will file a case in the court.

A.Hi,
The bond you have signed is an agreement between you and the company asked to that extent you would be liable when you break it. There it's no recovery proceedings in vogue though by which the company can recover the said amount on the bond. In case the company refuses to budge you need to approach the court to get an order to get your certificates released.

A.Hi,
While accepting the employment of your present employer, you have signed a bond and also accepted all the terms & conditions associated with the said employment including th4e said mandatory notice period. If you wish to resign now, you shall have to give notice and also pay the bond amount, as per law.

A.It would be better if you get the bond reviewed from a lawyer if you have its soft copy because without going through such causes in the bond it will be difficult to advise you anything but normally such employment bond is accepted unless challenged in the Court, even though you can use it to your advantage that it is not affirmed by Notary and no stamp duty is paid therein but still better get the bond reviewed to be on safer side and obtain proper legal advice. Thank you.
