Hi, We have our hereditary property and house for more than 100 years. My Grandfather died on 1990. Now (in 2021) one of my relative is claiming that he has a document for our land and he says that my grandfather sold the house to them already. And they actually shown a document which states that house is sold to them. We don't know how to proceed here, we are confused whether we can sell the land. any advise is much helpful.

Note: previously my grandpa sold some lands while he is in alcohol and our grandma went to court and claimed back that sold properties.

A.Dear Sir, If it is unregistered you need not bother. In any case never hand over the vacant premises of the building to him. just approach the Civil Court and get a temporary injunction order against him and thus continue the possession while litigation is going on for years together.

A.If that be the case then you have to approach the court and find out the truth as any agreement executed in inebriated condition is not valid. You can get in touch with a good and experienced civil lawyer and then move application in the court challenging the sale deed to find out what is what.

A.Hi,
Although the mother is not the natural guardian of the child under Muslim law, she has a right to the custody of the child, until the child attains a specific age. But the father or the paternal grandfather encompasses control over the minor throughout the complete interval of the minority.

A.Hi,
Even if your grandfather sold any property under the influence of alcohol it would term as a legal sale since it was done voluntarily. Secondly, if you think that the sale of the property is made on a false pretext, then you should check the date of the sale. If it is well within the limitation period then, a suit ca be filed for injunction. You should also check the property records with the revenue inspector of your region.

A.Hi,
You can cross-check the records at the office of the sub-registrar and also at the municipal land records to verify the sale. If such a sale has been made then the burden is upon you to prove that the sale of the property is in fact wrongful. If no sale has been made then you can simply sue your relative for defrauding.

A.Aap registrar office jaakar inspection kare ki kya tumahre dada ji ne property ko sale kiya h ya nhi yadi kiya hoga tab documents registrar office me registered hoga.
