Legal Notice Received from Bajaj Finance Limited within 26 days time

Hello Team, I am Venu from Hyderabad received a legal notice from Bajaj Finance Limited through an Advocate from Maharashtra. I missed my EMI from Bajaj EMI Card for June month, however my track record for previous months were good. I had conversations with the Bajaj Staff where they refused to give me time and on 23rd June'2021 I had a conversation with them, as they continuously told me me that they want to visit my home location for which I am not comfortable, I asked them to proceed legally rather just sitting on my head for payments, I mention my genuine reason as my wife who is pregnant facing multiple difficulties that had led me increases expenses which had not allowed me to pay my EMI's for June month and I also agreed to make the EMI payment including all penal charges by next month which was not taken into account by anyone. They sent a legal notice which they shared to wife's contact number on 28th June'2021 via whats app , not even by email. When I checked the legal notice it was dated 19.06.2021 however I had a conversation with Bajaj team on 23rd. Its truly un fare to see such notice where a person could not be considered as defaulter within 30 days of time and its as per RBI norms only. Do not know what could I do , kindly suggest. I could do payment of this EMI by 30th June'2021 but there is no one to listen my words. Kindly advice.
It seems to be a personal loan and they have no authority to come over to your house for recovery the same since house is not mortgaged. It is a purely personal loan and they have to take a decree from civil Court or Arbitrator. Just ignore their calls and be thick skinned.

If you have missed your emi, an increased interest rate is levied. If you haven't paid your EMIs, the lender will increase the interest rate and/or levy additional fees and charges on your loan. For the borrower, this could mean clearing off the outstanding along with paying for the legal fees and charges. However, if you feel that it was within the reasonable time frame then you register your query with the banking ombudsman of your jurisdiction.

You can either hire a lawyer and accordingly file a reply to the legal notice. Alternatively you may also enquire at the banking ombudsman's office regarding such strict measures and post your complaint.

A.Aap bajaj finance limited se ek baar persanly contact kare or apni sabhi problems unke sath share kare. Ho sakta hai ki aap ke baat karne se pahle unhone ye notice post kar diya ho. Agar ve aap ki baat nhi mante hai tab unko unke dawara diye gae notice ka jabab de.
