Hello; i need to know about the rules of video recording in govt office without consent of the officer in charge: In a case with one of my female contract employee wherein she was absent from work for almost a month due to lockdown and i've asked her to join the office otherwise i may have to engage some other staff living nearby for the period of lockdown and she can re join after the lockdown, and then she came to my room next day and starts recording video in her mobile phone which she was holding in her hand , upon noticing her i asked her not to do it, then she stopped. even though i asked her to join afterwards but i felt i was not at all wrong in informing her about the work conditions of company , and she should not have done this even after paying full months salary last year when she was absent for months together, now i am in a position where i am really scared if she files a false complaint against me in future if i try to be strict with her about the works etc. is there any legal provisions where i can just formally lodge a complaint about the illegal video recording or an advance complaint about her, while she was filming in her mobile one of my assistant female staff was also present in the room and she is a witness to it. pls advice as i can not terminate her from her job also since she's working as contract staff for almost10 years and she's got her family obligations too. Thanks

A.Dear Sir,
You have to handle the situation very carefully as the matter is sensitive. She has no right to record anything either on audio or video about the conversations between the officer with his staff members or others. You may lodge complaint with the police or higher authorities but be careful that she may also lodge counter complaint.

Aap ke dawra ye nhi bataya gya ki jab recording ki jaa rahi thi tab aap apne personal room par the ya duty par officer me the.
Agar aap office me the vo bhi apne. Tab vah aap ki permission ke bina koi recording nhi kar sakti hai. .kyonki office me aap ki company ke kuch importance documents or important equipment ho sakte hai.
Agar vah office me kisi file recording kar rahi thi tab vah company ke rule ke khilaf work kar rahi thi.
Isliye aap ki permission or company ki permission ke bina kiya gya aisa work law ki eyes me crime hai. Aapko turant apne senior officer ko batana chahiye ki aisa kiya gya hai.
And police me complaint file kare.

A.Hello sir/ madam
The absence of consent and malafide behaviour on your side favours your situation so you should either report this kind of behaviour to your department and ask for making a record of this situation and you may also report this to the police station as it is a breach of your privacy.

A.Dear Sir,
In a situation like this, you can definitely visit a police station or raise a departmental complaint so the issue remains acknowledged before it is propounded beyond your control. As it is a matter which leads to disturbance of privacy due to lack of consent before taping. However while filing a complaint make sure you go with a clean hand and there is no hidden malice while filing the complaint, which eventually could nullify your entire cause for filing the complaint.
