Service Matter-Should i file a writ petition or wait for Internal inquiry?

मेरा नियोजन जिला पदाधिकारी द्वारा संविदा अंतर्गत किया गया हैं. मैं लगभग 5 वर्षो तक कार्य कर चूका हूँ. परन्तु जनवरी 2021 में 2017 के किसी निदेश के अनुपालन में मुझे जिला स्थापना वापस कर दिया गया हैं. अभी तक जिला पदाधिकारी द्वारा कोई भी निर्णय नहीं लिया गया हैं मेरी संचिका अभी भी जिला स्थापना में लंबित हैं. मुझे क्या करना चाहिए जिला पदाधिकारी के निर्णय का wait करना चाहिए या high court का रुख करना चाहिए.

You may contact service advocate who will take the decision what type of petition is to be filed and also suggest before which forum it has to be filed. Because it can be filed either before High Court or before Service Tribunal.

A.Hi,
If there is unreasonable delay in enquiry then you can file a writ petition in high court. Unless you can wait for internal enquiry to move further.

A.Hi,
In my advice you should wait for the internal enquiry to end first, you can adduce evidence before the nodal officer and prove your innocence. If you are not satisfied with the results of the inquiry, there on you can file the writ petition before the HC, challenging the inquiry.

A.You can and should file With Petition. In such cases a letter of your intention is given to the authorities involved and when no action is taken which usually happens then you can file Writ petition

A.Aap ko turant writ file karni chahiye. Kyon ki service matter hai. Aap ke khilaf jo inquiry chal rahi hai. Usko bhi aap ko challenge karna chahiye. Ab aap dawara fact nhi likhe gae hai. Isliye aap ko uchit salah dene me thodi preshani hai.

A.Let the internal enquiry happen first. Directly you will not be able to file Writ Petition. Try to prove yourself before the lower authority before you head on towards High Court. If the matter gets solved through internal enquiry than you will not require to approach High Court. Thank you.
