I have a land(fallow) in the name of my grandmother where some Muslims people illegally show possession. I've all the original documents but those people's don't have. I complained to police but no action was taken by them. Also when i called government amin for measurement of land they started to quarrel with us and stop the measuring process and file oppsite case of quarrel on us . We file counter case but no action is taken till now. The case is continuing. On that land we also have teenants. What should we do to measure and construct the land

A.Dear Sir,
You may file suit for possession or recovery of possession or permanent injunction and thus claim the property since you are having sufficient original documents to establish your ownership.

A.Hi,
If you have the documents, you can directly move to court seeking the eviction of those people. Original documents are primary evidences and there is no other evidence better than that. You can also ask for compensation if you had any losses because of the inappropriate response from the public servants.

A.Aap ko koi jhagda nhi karna chahiye. Agar unke dawara aap ke khilaf koi criminal proceedings ki gai to usko defense kariye. Kyon ki aap ke pass sabhi paper hai to aap ko civil court me ejectment ka suit file karna chahiye. Court aap ko sunegi or ek proper order pass karegi.
Police aap ko koi help nhi karegi kyon ki police sir moke par shanti kara sakti hai.

A.Hi,
If you have the original documents nothing to worry. If your tenants have any disturbance because of them, make them to file a complaint too. You can move to court for the possession of your land and eviction of those illegal occupants. You will get justice.

A.If you have all the original documents in respect of the land than you can just evict any illegal occupants out from your property and since they don't have any documents they will not be able to take any legal action against you for their eviction from your property, however only if in case the circumstances demand (if there is any physical quarrel/violence like you have mentioned above) you shall seek police protection in your matter. A.You have to involve higher authorities by writing to them like SDM, DM and even Divisional Commissioner. Even after that if no action is taken then you can file Writ Petition in the High Court. Prima facie your case looks that of maladministration by authorities. You can take the above mentioned recourse
