A.whether you want to open a company and then start your business or just start your business is your choice. As soon as you form a company you have to make compliance according to the companies Act and the rules made thereunder and that is mandatory and in some cases default involves punishments also as per the new companies act 2013 eg default in filing annual return etc. Legally you do not have aq company unless you register it. Having a duly registered company has its own advantages.

A.When you are doing business get your business a legal entity like proprietorship, partnership or pvt. ltd. company. There are different processes to do that. Once you have got your company registered in any form then you can go for other formalities like GST, Trade License etc. Finally get your business Trademarked then no one will be able to copy you.
