I am working in Gujarat State Government organization as Junior Assistant, class-3 officer. I had raised grievance for not considering my UGC approved Distance learning mode bachelor degree in my promotion & higher grade, They are not give me any kind of reply or react on my grievance. As per Department circular Year 2018,"If they acquire qualification of graduation from open University, only two National universities will be consider for promotion as well as higher grade which are IGNOU& BABA SAHEB AMBEDKAR OPEN UNIVERSITY. i was start my Bachelor Degree Course in Sikkim Manipal University from 2016 and finished my course in 2020.I have not been considered eligible for the promotion in spite of my seniority over my colleague who has been promoted. So please give me suggestion for further legal jurisdiction of my legal rights

A.Dear Sir,
You may approach Service Tribunal or High Court to get your grievance redressed. Service rules cannot be changed after your entry which affect your service benefits and you will get all the benefits which you were entitled as on the date of entry into service.

A.You need to write to your department then after that you should file a case in the High Court, a writ petition against this injustice done to you post having a detailed discussion with a good and expert lawyer with all your information and papers.

A.Hi,
There are two viable courses for you to resort to. You may either register a complaint with the State Employment Dispute Redressal. Alternatively, you may approach HC and file a case for a violation of your fundamental rights for no seemingly intelligible classification.

A.Hi,
Usually, there is no reservation in the promotion standards, and in your case, it seems that it is warranted by merit. You can either register your complaint with the state employee grievances commission or can approach the HC under Art. 226.
