Family certificate showing names.
Hi my are divorced for about more than 45 years . I have been staying with my mother since then . My mother recently passed away . She did not write any will, and I have applied for family certificate. In my Mother's death certificate it shows daughter of "My grandfather name" and family certificate shows wife of " My father's name" . Now in order to sell any plot under my mom's.name. Is it required to add my grandfather's name in family certificate or is it required to add my Father's name given that I do not have any contacts with my father anymore
A.You may apply for succession certificate stating that you are the rightful person to be the successor of the deceased person i.e your mother and you can go ahead with the selling of the plot once you attain the succession certificate from the court.
Instead for applying family certificate you could apply for succession certificate as you are the legal heir of your mother's property. Once you have that certificate you would able to sell that property to anyone. Also after her death and obtaining the legal heir certificate from the court you'll have to mutate the property in your name and ten you'll become the owner of all the property and could easily sell it in your name. there would not be much of a problem.

It would be suggested to obtain a succession certificate from the court. Afte to obtaining that you'll have all the right over your mother's property and sell it easily.
Thanks.
