A.Dear Client,
Yes, you can file for divorce under Desertion as you and your wife are not living together of 2 continuous years and it is a valid ground for divorce in family court. Your divorce can filed under the same Religious personal law in which your marriage was solemnised.

A.Yes you can file a case for divorce. If you wish to file for MCD then you can go ahead but if you wish to file for contested divorce then you got to discuss with your lawyer to figure out on how you should be putting things together.

A.yes only if the living separation is not by mutual agreement and you not the reason for your wife to live separately. If can start by filing a case of judicial separation application which can only be filed within one year after marriage

A.Aap divorce ke liye jaa sakte hai. Kyon ki aap 2 years se physical relationship me nhi hai. Isliye aap is ko base banate hue divorce petition dakhil karna hoga. Kyonki law me section 13 hindu marriage act me isko define kiya gya hai.

A.Hi,
Desertion is also ground for divorce in India. It actually means when a party to the marriage permanently leaves the other party without any valid reason and without the consent of another party, that would amount to desertion and becomes a ground for divorce.

A.Hi,
Yes, Desertion is a ground for divorce. The decree granted under the Hindu Marriage Act, allows for divorce on the ground of one of the spouse having deserted the other for a continuous period of two years before filing of the petition.
