Forgery and cancellation of anticipatory bail
2 years ago
Sir i have filed a F.I.R my o.m.r sheet has been forged by college principal and staff under section 420,467,468,218 of IPC but police is taking unfair advantage from the accused and preventing the arrest of accused .How can i Approach high court to Cancel accussed Arrest Stay and Anticipatory bail
A.To seek cancellation of anticipatory bail one has to show to the court a cogent reason why the accused bail should be canceled for example the accused is not turning up to the court on due date or not fulfilling the bail bond conditions. Merely on complainant's application to cancel the bail the court will listen to you.
Hence what you can do is to hasten the process of investigation and trial by speaking or writing to SP or concerned SI of the PS.

A.Cancelling anticipatory bail by the private complainant without the state's indulgence and support is very difficult and therefore rather than focussing on cancelling of the bail one should direct the attention towards the progress if the investigation and if you have reasons to fear that the IO and the accused are hands in gloves with each other then you can first write to the SP and then file a writ petition to bring the matter before the concerned court.

A.Hi,
You can move to SP office and give a complaint. If proper investigation does not take place, with your complaint receipt, you can move to court and file a complaint. Forgery is a crime in India and whoever commits forgery shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
