How to know whether my wife has remarried or not? How to know whether my wife has remarried or not?

Dear respected sir/madam
I am fighting multiple cases and paying maintenance to my wife for last 4 to 5 years. I got to know she is been married for last 3 years and having child from new marrige though our divorce is pending. In my personal capacity i got to know her new bank account no in axis bank where she uses her new surname by changing surname in ADHAAR. My question is how to get the document from the bank or from UDIAI about her application form and kyc papers submitted into the bank. How to get details from bank or from uidai? With relevant details of the existing cases running where its clear that i have substantial ground to ask personal details.need help to het the details from uidai about her name change and marrige document.

A.Hello Sir
First of all you are not allowed to get someone's personal information and neither bank would give any kind of personal information of their customer i.e. your wife. You'll have to investigate in your own capacity and find out evidences of her second marriage so that you won't have to pay maintenance and get divorced easily.

A.Hello
First of all the bank would not provide you with kyc details and all of your wife, bank would not share personal information, you'll have to collect evidence of your wife's second marriage yourself. You could start with asking neighbour of your wife and collect evidence to show the court that she is married and you could get a divorce on that basis easily.

A.In matrimonial cases you can take the help of a detective agency yo collect all the evidence against her like her remarriage and having kid with that marriage. The agency can also get the details from the bank through its sources and other evidences which you can produce in front of the court to strengthen your case.

A.Dekho bhai bank kisi ki personal details nhi dega .aap ko khud hi pata karna hoga ki aap ki wife ne dushri marriage ki hai ya nhi. Vaise aap apni wife ke mata pita ke place se kisi se pata lga sakte hai ki usne. Marriage ki hai ya nhi. Agar aap ko pata lg jaata hai tab aap us town ya city se jahan usne marriage ki hai proof collection kar sakte hai. Agar aap ye proof kar dete hai tab maintenance nhi denge or divorce ke liye aadharhoga or divorce mil jaiga.

A.Axis Bank, being private sector bank is beyond the ambit of RTI Act.

UIDAI disclosure norms states:
As per section 8(1) (j) of the Right To Information Act, 2005,as amended up to date and in view of the confidential nature of demographic and biometric data (personal data of resident) only the resident to whom the data relates can seek the information. No other applicant can seek this information. No other applicant will be provided with any personal information related to a third party or any other resident to protect privacy and maintain confidentiality of residents enrolled under Aadhaar program. Applicant may also be required to provide additional validation of identity in certain cases.

So as per Law you cannot get the personal information of your wife from AXIS Bank or from UDIAI .

A.Deploy some private detective and try to collect all details about her second marriage and her children from such marriage. Although the second marriage is nullity in the eyes of law but the fact remains that she has been indulged in an adultery will disentitle her from the maintenance. Unfortunately the private bank cannot be compelled to produce those KYC related information. Marriage document is a public document which can be obtained from the registrar office on payment of requisite fees and on making an application in the prescribed format.

A.Please file application in that particular Court for directions to her to submit affidavit. Now it is mandatory to submit affidavit in all Domestic violence and Divorce cases. Thanks

A.It would have been more easy to prove your case before the Court when your wife was pregnant from her void second marriage. Anyhow now you straight away apply before the Court an application asking your wife to submit her bank statements at that account along with her passbook and also produce her Aadhar Card attested by UIDAI authority before the Court, also if you are sure than you shall demand DNA test of her child from her void second marriage or to produce birth certificate of the child attested by Municipal Body. But before doing any of this collect evidence to convince the Court regarding this such as may be photograph/video of your wife and her illegitimate husband and illegitimate child from that void second marriage. Thank you.
