My wife has filed false DV and she is adultery .. now she is claiming to stay with me .. my kids 6 years and 10 years old are with me . she is deamnding in DV section 21 ?

How to handle DV mediation case now ?

A.Hello,
Mediation in dv case is to make both parties sit together before mediator both parties discuss their problem and mediator after listening them try to sort out the matter amicably. In your case if your wife is in adultery you need to prove that. If you don't want to continue your marriage file for divorce in family court.

A.Hello
If a false complaint is registered against you by your wife for false DV, you have two options – either to defend your case and wait for the judgement or to file a counter case against your wife and prove her wrong.
Also the DV mediation case means that you and your wife would he make to sit together and solve your issues amicably via mediation and come to common terms and conditions so that you two could live together again like before and in order to avoid divorce proceedings.

If your wife is climaing to stay with you that means she wants to settle the issue through meditation, that means you both would agree on mutual term and try to live together. If don't want so you could proceed with the divorce petition with the help of your lawyer proov that the Domestic Violence case is fake.

A.Dekho koi tension nhi lene ka hai. Domestic volince me arbitration ek dono parties ke bich samjhota karane ka effort kiya jaata hai. Agar aap ke pass uske khilaf koi solid proof hai.Jo usko hit karta ho or aap ko support karta ho usko arbitration ke samne submit kare. Agar aap ka problems solved nhi ho paata hai phir aap case ko defend kare.

A.Dear Sir,
You have to produce evidence in respect of adultery and file immediately divorce case on that ground and you need not pay any alimony as she is leading adulterous life. She has no rights to have custody of children as she is not maintaining moral laws and you will be entitle for custody of child.

A.In mediation what will happen is that both the parties will be made to talk to each other and made to understand and convinced that you you have to stay together on the agreed terms and conditions and if anything goes wrong then the person committing the wrong will be punished.
If she is invoking Section 21 which means that she will have the custody of the children if she decides to stay away from you and you may get the visiting rights as per the mediation terms.
