Hi Sir/Madam,

I have been married for 5 years.. from day 1 they were mentally torturing me in many ways.. they were keep on abusing me and my parents . I am working woman they don't want me to work that is one of the reasons and my brother in law's calls me blacky and crow bcoz I am black in colour.. my mom got cancer so they were at my place for more than 1 year for hospital and medication. For that my mother in law asked my husband u were going there bcoz to sleep with ur mother in law that is my mother.. I want justice for this how can a mother can talk like that.. is there any way I can proceed to file a case against them..

A.Dear Madam,
You may file DV case as follows:

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,
4. Pass orders u/s 20(i) granting Rs.25,000/- per month as maintenance for applicant and maintenance at the rate of Rs. 5,000/- each per month to her three children.
5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,
8. That any other order/s, this Hon’ble Court deems fit, to meet the ends of justice, be passed.

A.Yes. You are entitled to lodge FIR in the local Police Station u/s 498A of the Indian Penal Code,1860, as amended up to date against your in-laws on the ground of mental torture and cruelty exercised upon you as well as for the domestic violence and they shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.

For the obscene acts and words on the part of your in-laws,you can take steps u/s 294of the Indian Penal Code,1860, as amended up to date and they shall be punished with imprisonment of either description for a term which may extend to three months, or with fine, or with both.

A.Aap ko agar partadit kiya jaa raha hai tab aap court me case file kar sakte hai. Aap police me complaint file kare sakte hai. Domestic violence me bhi jaa sakte hai. Aap 498 a me bhi jaa sakte hai. Depend aap par karta hai ki aap ko kya karna hai. But sabse pahle aap ko apna married life surakshit karna chahiye. Kyon ki bahut pavitra rista hota hai. Itni jaldi designs lena ki marriage ko toda jaae thik nhi hai.

If your in laws are torturing you then don't be afraid and file a domestic violence case against them. the court would surely help with you in this case. Also you could file a case against for causing mental agony to you.

Get out of that house and file a domestic harassment case. Normally most victims don’t come ahead and report because of fear of family pressures and fear of losing respect. What’s most important is if you keep on bearing this torture then you would be nowhere and feel like you are dying from inside. Just wake up,be bold enough to make the move. Today the legal system is very much improved and justice will prevail for sure in most of the cases. Just one complaint and it will surely help you through the process. And if you need anything just let us know. There are tons of good people here who can help you out. Don't be so afraid and reluctant to approach the law.

A.As you said your mother-in-law and father-in-law are harassing you and mentally torturing and abusing , you can file a domestic violence case against them and seek remedy under Sec498a of IPC through a lawyer.

A.You can take recourse to Protection of Women from Domestic Violence Act, it's a very good act encompassing all the protection and reliefs one wants, you can even continue to stay at matrimonial home without any fear while maintaining court case, a protection officer would be provided to you, engage a good lawyer, draft a good petition writing all dates and events.
