Dear Sir/Madam, I have the below concern. Please let me know on the same. In my pendin Divorce case from past 5 years, respondent wife party have submitted her written statement after 1.5 year which is after 450 days of the receipt of Divorce Summons. Even court took their 450 days delayed written statement on record that time with cost of just Rs 500 and that too without any Affidavit. This got exposed after 5 years and the court took statements from the respondent wife party and her lawyer as they have assured court in writting on the very first date that they will submit the written statement on next date which is signed by them but still they didnt submitted it as assured to the court in writting and now after 5 years it got exposed and court took their Jabani/statements. Please let me know what will be the next step.

A.You can question the act of court in allowing wife to file written statement after prescribed period. Latest supreme court judgement also confirm that reply should not be accepted veyong prescribed period. You can also question act of court taking the same on record.

A.Hello,
if both parties are in agreement on divorce, the procedure should have been completed sooner. You might ask to replace your lawyer, or you can try to reach an out-of-court settlement to expedite the divorce process.

A.Hi,
if both the parties are at a mutual understanding of divorce then the process should have been resolved at an earlier stage. You can seek to change your advocate, and or seek to get out of court settlement of the matter and seek for a faster divorce process.
