Minor muslim child custody to father

We belong to muslim family, my brothers wife dont want to stay with us ,they r not divorced ,but the matter is running now,if they apart so can we get our child ,my brother is in uae ,we can brought up child in luxurious way, childs mother is not even educated. Child is only 1 yr old.
