My husband's friend was accused of rape by his girlfriend, and the girl falsely Compalined against my husband also stating that as a friend they are supporting his boyfriend for doing such things, and also my husband is involved for Taunting and Threating the girl's family. As per the FIR police has imposed 509 and 114 against my husabnd and other 506 376 IPC against my husband's friend in the same FIR. Please guide me 1 . Do my husband need to get bail from court for this? 2 . How can i go with the case? 3. How can I filed a case against them as they are falsely framing my husband and try to defame him? Please guide.

A.Dear client,
sections imposed against your husband are bailable offences. So he can get bail. If your husband is not arrested yet you can move anticipatory bail petition in the court of session. If it rejected at court of session then you can approach Highcourt with the petition. You can file defamation case against the girl's family in the court of law.

A.Hi,
You have to consult a lawyer. The allegation against him is serious in nature, so it is important to consult a lawyer and detail him the facts of the case. You can give a police complaint for defamation.

A.Hi,
You have to consult a lawyer. This case is serious as he is alleged of raping a girl. You can prove her intention and if she had any issues with your husband before, you can mention that too. You can give a police complaint for defamation too.

A.Since the Sections applied to your husband are bailable hence you can easily get the bail on appearance in the trial court but suppose if the opposite party ( Prosecution) opposes it with some solid ground then he will not be getting bail and might be rejected. In this case taking anticipatory bail is good option to save himself from getting arrested or any other hassles.
