My brother was caring for my mother for 4 hrs and I and my older sister used to live out of town. Relations between my younger brother and his wife were always contentious. During our absence my brother Forcibly took control of all the papers regarding our inheritance and the money our father left for our mother. This led to a deterioration of her health and she was subsequently pushed out to live in an ashram with the pension she was getting. She died in 2017 from ill health and the realization that she was not getting her money back. We were completely kept in the dark and our brother says the money is stuck and he has been duped. Now I want to have him arrested for basically ignoring my mother and allowing her to die. He has emailed my earlier stating that he has the last will from our mother and that he will get the money back. Now we know all the money he invested is not coming back.

Do I have a case?

A.Hi,
If you make such a claim that your brother acquired the property of your mother by fraud, the burden of proof lies on you. You have to produce the evidence in court. You can sue him for his cruelty towards his mother.

A.Hi,
You can give a police complaint. If you think he transferred the property of your mother to his name by fraud, then you have to prove that in court. The burden of proving that lies on you.
