My Mom had Covid and she was admitted to Ranchi Hospital. We paid almost 2.45 lakhs for 5days treatment for ICU bed whether NABH has provided capped of 8K,10K,and 18K for private hospitals. But hospital charged around 45K/day for ICU excluding medicine. Now, i am in Pune just want to check whether i can file lawsuit from Pune or not and how much this will be helpful for me. I am having all bill and payments details.

A.hospital said no beds available.
you begged that you will pay more.
they gave you bed to get more money.
you take refund of extra money after discharge.

you can succeed but you have to file in ranchi
why hospital will come to pune for you or your case ?
tomorrow a budback will go to jumri taliya and file case there.

A.Hello Ma'am/Sir
It would be advised to file a suit in the consumer court in Ranchi against the Hospital for overcharging. You could intitate with sending a legal notice claiming your money you over paid.
Also you cannot file a suit in Pune as the cause of action arose in Ranchi.
A complaint shall be instituted in a Consumer Forum within the local limits of whose jurisdiction the opposite party resides or carries on business or has a branch office or personally works for gain, or where the cause of action, wholly or in part, arises.

A.Dear client,

Yes you can file the case for the same before the Consumer Forum Department.
Beside all this, you can report the same to the hospital authority by mails or send a legal notice. They might go for a Mutual understanding and refund you back the same without a suit.

A.Hello Client,

You can file a complaint case before the consumer forum of your jurisdiction or before the hospital's jurisdiction.
You can file the case for recovery of the excess amount with all the documents you have with you regarding the same.

A.Hello Sir/Ma'am
If you were overcharged for the services then you could file a suit against the hospital in the consumer court. As the cause of action arose in Ranchi the jurisdiction would be of there, you cannot file a suit in Pune.

A.Dear Sir/Mam,

You have the jurisdiction of filing the case where you mother was hospitalized as the amount charged was in excess. First of all, it should not have been mentioned whether the hospital is private or govt. as the private and govt. hospitals rates are different. And the case depends on that only.

A.Yes. You can file consumer complaint before consumer commission where you are resident against the hospital and can claim damages and refund of excess amount. You can also file suit for recovery and damages against the hospital. You can also report the matter to health ministry, CMO etc.
