Appreciate if you please let me know the remedial legal
options available to me against the management of my
Institute, a Deemed to be University for doing a cover up
Operation by constituting a managed “Fact Finding Inquiry”
wasting my time and other resources.
The report submitted by it did not addresses even a single listed issue,
substantiated with documentary evidence. Please let me know the followings: -
a) What type of case can be filed and where? e.g., tort
b) Can one claim for damages against the Director/CVO?
c) Can you please provide some links of some HC or SC reportable reference material?
d) Any other advice so as to have justice for my harassment.

A.Facts and findings are required to be examined. If final report has been filed then you can challenge the inquiry proceeding, its constitution and finding in court of law to set aside the finding or order and if any adverse action has been taken then you can also ask to set aside such action etc. You can claim cost only. As such in India no law of tort is applicable.

A.Hi,
You have to contact a lawyer and detail to him the facts of your case. You can file a tort case if you had any losses pursuant to this action and the person against whom the case should be filed depends upon the facts of your case.

A.Hi,
It depends upon the facts of your case. If you had any losses, you can file a tort case and the court will consider that matter. You have to contact a lawyer and get legal advice.
