A.No, you can't, if your husband is alive and came to know the fact of your marriage, you will be in trouble for sure,

A.Dear Sir,
In reality without court divorce papers you cannot marry for second time. But you can say there was customary divorce which is recognized by Supreme Court in the following judgment.
Supreme Court of India
Yamanaji H. Jadhav vs Nirmala on 1 February, 2002
Author: S Hegde
Bench: N. Santosh Hegde, Doraiswamy Raju
CASE NO.:
Appeal (civil) 4969 of 1998
PETITIONER:
YAMANAJI H. JADHAV
Vs.
RESPONDENT:
NIRMALA
DATE OF JUDGMENT: 01/02/2002
BENCH:
N. Santosh Hegde & Doraiswamy Raj

A.First file petition for divorce on grounds viz.
- he has deserted you for a continuous period of not less than two years immediately preceding the presentation of the petition; and
- he has not been heard of as being alive for a period of seven years or more.

A.If a person is missing for 7 years then as per law it is Declared death in absentia. Do you have any police complaint or missing report prior to 7 years. If yes then we can get it done for you without going for divorce. Contact for further necessary action
