My daughter got married last year June 2020 within a month her husband and his family dropped my daughter to my house. He is a womaniser, he spoiled her life. She is totally depressed and wants to continue her life with him she loves him. We have given dowry and jewels worth of 50 lakhs. Due to covid her sister-in-law was saying and she will go to her place at the earliest and all they informed but actually she stays there only with the kid and given troubles by portraying stories. Finally they took to their house in the month of December after writing and giving to the lawyer something like memorandum of understanding with few points. Again he dropped my daughter after 15 days saying she is in affair and all indeed made character assassination that my daughter sent nudes to someone and all when asked for proofs they are ready to bring a person and convey verbally. But she is an innocent woman. After discussing with relatives, they told we will go and drop her to her in-laws. We came and dropped but her husband ran away the same day and he is staying in ground floor house and they are not letting my daughter to go outside she is only allowed to use kitchen and her bedroom it’s been more than a month, her in-laws are torturing her mentally she cooks separately. Husband secretly comes home eats his food when my daughter is sleeping and when she is in room. What should we do now

You can file a case for restitution of conjugal rights against husband and domestic violence against concern persons who are creating disturbance . Simultaneously claim for maintainance . Characterassasination is also a ground of cruelty so if they accepting and taking it a ground then you can also take this ground as torture ground against you.

A.Donot spoil the life if your daughter any more. Go strategically. Your daughter should consult a good and competent lawyer and should get rid from this relation and should start a fresh life. Husband does not seem responsible and the life of your daughter may get spoiled. Talk to your daughter and try to understand as to what she want. Try to make her understand the hard truth based on behaviour of her husband. If she agree then exhaust legal remedies available in law. Donot rush to file police complaint or cases as the same spoil relation further.

A.Hi,
Giving and taking dowry is an offense. In this case, you have to file a police complaint at your nearest police station and after the investigation, they will submit chargesheet in court. Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be pun­ished with imprisonment for a term which may extend to three years and shall also be liable to fine.

A.Hi,
According to THE DOWRY PROHIBITION ACT, 1961, giving and taking dowry is an offense. You can file a police complaint and they will investigate and produce chargesheet in court. According to Section 498A of IPC, Whoever, being the husband or the relative of the husband of a woman, subjects such woman to cruelty shall be pun­ished with imprisonment for a term which may extend to three years and shall also be liable to fine.

A.Dear Sir/Madam,

You must file the complaint in CAW Cell in respect of the mental torture they are doing with your daughter. And if they are not accepting her and doing unnecessary quarrel, then there is no point of being with him as otherwise they will make troubles for her. Kindly share in detail whether they both have cohabited after the marriage or not. Your daughter has a right to live their in her matrimonial home.

A.It is necessary to lodge complaint u/s 498A IPC,1860 as amended up to date,on the ground of mental cruelty exercised upon your daughter by your daughter's husband and in- laws by abandoning her often through character assassination as well as for the demand of more dowry and other things. Upon proof they shall be punished with imprisoned which may extend to three years and with fine.

A.Dear Sir,
Your daughter may lodge a serious complaint and see that he lose his job and behind the bars for few days. All laws are in favour of married woman. Due to prestige issue many married women are not approaching the Police and Courts as such the number of such husbands going on increasing.
