My company issued me joining letter in 2020 Jan however due pandemic delayed joining as it's an aviation industry. After the launch of the airline was informed to contact hr and has contacted on several occasions even to operations head, gm, etc etc. Can I sue the company on the basis of this fraud and cruel behaviour in crisis times.

A.Hi,
"Whoever dishonestly or fraudulently conceals or removes any property of himself or any other person, or assists in the concealment or removal thereof, or dishonestly releases any demand or claim to which he is entitled, shall be punished with imprisonment if he does not return the amount duly," according to Section 424 of the IPC. You can register a complaint with the police station or the company's grievance redressal system if you desire. However, during this moment of crisis, numerous modifications to the legislation have been enacted, allowing corporations to follow the path of need and force majeure, which you must be aware of.
Thank you very much.

A.Hi,
Section 424 of the IPC states that "whoever dishonestly or fraudulently conceals or removes any property of himself or any other person, or dishonestly or fraudulently assists in the concealment or removal thereof, or dishonestly releases any demand or claim to which he is entitled, shall be punished with imprisonment if he does not give back the amount duly. If you wish you can file a complaint in the police station or the grievance redressal of the company. However, this crisis period has made many amendments to the laws, here the companies can take the course of necessity and force majeure, which you have to be careful about.
Thank you.
