My husband married me two years ago, and left me at my parents house ever since, he refuses to pay maintenance money, he refuses to issue my visa to come live with him even though he easily can, he also refuses to divorce me. His parents and brothers are not helping me. How can I legally get him to divorce me? Seeing as I wish to continue this marriage and live with him, but if he won't take responsibility I wish to get him to divorce me.

A.Hi,
You can approach the court for the restitution of conjugal rights. A decree of restitution of conjugal rights implies that the guilty party is ordered to live with the aggrieved party. If you want a divorce, you can approach the court for that. Please contact a lawyer for further advice.

A.Hi,
You can approach the court for the restitution of conjugal rights. The court may order your husband to live with you after considering the facts of the case. Or you can file a divorce petition if you want. Contact a lawyer for Further advice.

A.It is necessary on your part to file an Application for Restitution of Conjugal Rights before the Civil Court u/s 9 of the Hindu Marriage Act,1955, as amended up to date so that your husband either has to explain the grounds for not staying with you or has to specify that he is willing to get divorce. For maintenance purpose,you have to file separate application in Magistrate Court u/s 125 of the Code of Criminal Procedure,1973, as amended up to date.
