I have started working in a company from February 2017 and I have signed an employment bond for a period of 4 years. I worked from February 2017 to November 2019 for a period of 33 months out of 48 months in total. I did not like the work I was assigned to do and wanted to pursue the higher studies. I told my director and HR department that I could not possibly pay back the bond amount and I asked them to accept the resignation. HR kept emailing that she would file a police complaint against for absconding.
In fact I did not abscond, I did not change my number or my email. I was communicating totally with the HR department. She kept sending the letters to my home saying that if I didn't pay the bond money of 5 lakhs, that I would be sent to the jail. I am pursuing the higher education now. Please tell me what can I do so that they could give me the resignation letter and the experience letter which they withheld.

A.Hi,
If you were not absconding and can provide the proof of the communication to the police, then it would be considered as a civil case. Now, if the refuse to issue experience letter, then you can file a complaint in the office of the labor commissioner, and get the issue resolved.

A.I hope you have all the documentary evidence of sending mails and communication with your HR and company. If you have then when they file the complain with Police then you can show those to the police and they will understand that this is a civil case and not criminal.
