Hello there,
I have recently took services for pest control (bed bugs) and they have told me that they will provide 4 service for amount ₹700 (After discount, actual was 1000/-)
They have given me first service, & took the entire payment, although service was satisfactory.
But, when I request them to send for 2nd service, they are making some excuses, that "Our workers are busy, our workers not working today, etc etc. Due to which I not able to sleep properly, because infestation of bed bugs are increasing day by day.

For the purpose of evidence I have What'sapp chat and some voice chats send by them and have details of regular conversation over call (But not call recording)
And initially they told me that they will provide a bill but they only gave me their card and wrote about 4 service on the back of it, said we only provide card on a services amounting more than 1000/-

I have 3 questions :-
1) Can I, by my self, send a legal notice to them for either providing me service or returning my money with compensation? (Do I need to engage a lawyer for sending a legal notice, is there any law for that?)

2) Are evidences sufficient enough to prove my case? (I don't have bill, but visiting card provided by them)

3) If they are not responding to my notice, should I proceed consumer case or send another notice?

A.Hello sir/Ma'am
1. No, you cannot send a legal notice by your self, a legal notice is needed to be sent on a letter head of registered advocate. Therefore, you are required to engage a lawyer to draft a legal notice for you and send it on your behalf.
2. As per the information provided by you about the evidence, it sounds pres sufficient you send a Legal notice on your behalf and to go to a consumer court in case of need.
3. Yes, you have all rights to proceed with filing a consumer case against the service provider in case they didn't act as per the legal notice.

A.If you want you may send legal notice yourself but it is likely that the other side may not treat it as legal notice being not from lawyer so it is perception based matter and secondly for Rs 1000-2000 it is hard to analyse whether one would really want to file a case. Thank you.
