I have been asked to resign on 2nd August after 2 minths working and with mutual agreement 31st August is finalized my last date in the IT company I worked, now they are asking me if I have worked 100% commited or 50% commited in the notice period to finalize my full and final payment. If they don't pay me in full what options do I have to get the full payment under labor law.

A.Hello Sir
It's the company's obligation to act according to the employment agreement agreed between you and the company. In case they doesn't pay you the full payment then you have an option to send the company a legal notice with the help of a lawyer to make the company act according to employment agreement. And if the deny to do so then you have all rights to proceed with initiating legal action against the company.

A.If they don't pay your full and final as per the employment agreement and your current salary then you can meet up with a lawyer to send them a legal notice to recover your dues. Ideally after receiving the legal notice the employer should pay your dues.

A.You can issue legal notice to them to comply with your claims and if they do not reply or comply with your claims in 15 days than you can file a complaint at the office of labour commissioner of your concerned jurisdictional area or you may file a case in the labour Court or if you have signed employment contract than check the clause provided therein for dispute and if you deem fit you may proceed accordingly. However please remember till the matter goes on your career would be stuck as you will not be able to relieve completely from your current job as regards to certificate, recommendation letter etc if you are resigning to join another better prospect and even if you manage to it will be stressful in a way so think carefully of these factors and proceed accordingly. Thank you.
