Right to husbands property in case of divorce
5 years ago
I married in Nov 2016. Have a baby; 10 months old and diagnosed with Acute Leukamia.
To avoid medical expenses, my husband simply left me to handle the situation alone. I am unemployed. The child is undergoing chemotherapy. T
Do I have any legal possibility to handle the situation.
In case of divorce, am I entitled to a right to properties belonging to my husband?

A.Madam
You can file maintenance proceedings under the Domestic Violence Act in the concerned Magistrate's court and also claim maintenance under section 125 of Cr.P.C. In case of divorce you will be entitled to alimony which is decided by the court or may be mutually decided between the parties.

A.Try to resolve it amicably, and try to get sufficient alimony for you and expenses for child's welfare, maintenance and eduction. If not possible, then you need to file for divorce and claim for alimony for you and expenses for child. Take assistance of local Advocate.

A.Your husband has a moral and legal responsibility t pay for medical expenses of the child. He cannot escape from his responsibility to look after the child by way of paying expenses of treatment besides paying maintenance. If you are earning then you have also contribute towards medical expenses. BT so far as your husband is concerned, it is his responsibility at the first instance. Whether u are earning or not he shall have to pay for medical expenses being the father. So far as right in his property is concerned u won't have any such right after divorce.whatever u can claim u have to do so in the form of permanent alimony. Better u resolve all disputes for the sake of ur child.but considering conduct of your husband it seems to be a remote possibility. In other way u Can opt for divorce by mutual divorce.
