A.Hi, you can file a criminal case claiming medical negligence only if you are sure that the doctor has been negligent or reckless in discharging the functions. It would be advisable to has a word with the dentist, he/she might be able to explain why they did that, and it could be a part of the procedure / medical necessity. Proceed with a criminal case only if you are convinced that the doctor was negligent. A consumer case of "deficiency of service" on part of the doctor may also be a good option to consider. A.Why do yo want to file a criminal case against the dentist? A criminal case might not be good here as the dentist may be able to prove that it happened accidentally and there was not guilty mind "mens rea". Better you should go for consumer case to penalize him and get compensation for the deficiency of service.
