I've been staying at an rented apartment in Punefor 15 years and the first, 11 months rental agreement executed in 2006 was never renewed or re-registered.

The landlord lady passed away an year back and since she wasn't visiting her bank often, I used to pay the rent by cash, by hand.

Her son staying in some other city, suddenly started asking us the proofs of rent paid as well as threatening to settle with some good amount and vacant the space.

Now, all of the neighborhood, friends, shopkeepers, maid, other flat owners can state about our occupancy but I DONT have any proof other than these witnesses or Passport, Aadhar, License, Voter Id card or such KYC docs.

I would appreciate, if I get suggestions on How to prove my residence or challenge him if any legal action taken.

A.Hi,
Since you have been staying there for more than 12 years, you can use the defense of adverse possession. Adverse possession may be a term that’s utilized in our legal system when someone acquires ownership of movable or immovable property by continuous use of it. Please contact a lawyer for further advice.

A.If you wish to prove your tenancy then you will have to show some documentary proof like rent agreement or payment of rent. Since you were paying in cash I think it is not possible for you to show that. This being a difficult situation you can try for adverse possession rule as you have been staying there for more then 12 years. All said and done you will have to discuss with a lawyer threadbare to know all that you can do.
