Dear Sir,

I have filed divorce case against my wife and have informed her. At present she is living in her parental house for last 15 days. We have kept our home (Matrimonial house) locked since then and no body is staying there. Due to bad health of my mother she is staying with her relatives. And I am living on different other property which is on rent.

My query is that how can i avoid my wife entrance to matrimonial house which is at present locked and what if she tries to break the lock of the house.

A.Hi,
A married woman has the right to enter her matrimonial home as much as she has the right to enter her natal home. There is no legal provision as such to prevent her by entering the matrimonial home. Even trespass wouldn't stand since she has the right to enter the property. Only after the divorce has been decreed can you get a restraining order.

A.As long as she is married to you there is no way you cannot stop her from entering the matrimonial house as she has the right to enter the house. Even if she breaks the lock and enters yo cannot make a criminal case against her. You will have to devise some trick that she is not able to enter the house.
